Clients - Netmindst clients, entities for whom we provide personnel consulting services and marketing services (if separate consents are granted)

 

Employers - potential employers, entities interested in acquiring employees or people providing services.

GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation data).

2. PERSONAL DATA ADMINISTRATOR

Netminds is the administrator of your personal data.

3. WHAT PERSONAL DATA DO WE PROCESS, FOR WHAT PURPOSES AND ON WHAT LEGAL BASIS?

Netminds processes your personal data in order to provide services such as: applying for job offers, recruiting employees, acquiring customers.

The scope of data. For this purpose, we process personal data regarding your activity on the Websites, i.e. data regarding the job offers you view, educational offers, other marketing offers of Netminds own and cooperating entities, and data regarding the session, your device and operating system, browser, location and a unique ID, IP.

Legal basis. Necessity to perform the contract for the provision of electronic services (Article 6(1)(b) of the GDPR).

Determination, investigation and enforcement of claims

Netminds may process some personal data provided by you, such as: name, surname, place of residence, PESEL, NIP, professional experience, education and training, data on the use of Netminds services, data necessary to prove the existence of a claim, including the extent of the damage suffered.

Legal basis. Legitimate interest (Article 6(1)(f) of the GDPR), consisting in determining, pursuing and enforcing claims and defending against claims in proceedings before courts and other adjudicating authorities.

Consideration of complaints and requests, answers to questions

Netminds may process some personal data provided by you, as well as data regarding the use of Netminds services, which is the cause of the complaint or request, data contained in the documents attached to the complaint or request.

Legal basis. Legitimate interest (Article 6(1)(f) of the GDPR), consisting in improving the functionality of services provided electronically.

 

4. WHO DO WE SHARE YOUR PERSONAL DATA WITH?

Your personal data is transferred to the following recipients:
employers
We share your personal data with potential employers using Netminds services. Employers to whom we share your personal data, only with your consent, independently determine the purposes and methods of processing this data, without being subject to our instructions in this regard. This does not release them from the obligation to comply with the obligations of the GDPR.
Service providers
Netminds, we transfer your personal data to service providers that we use when running the Websites. Service providers to whom we transfer your personal data, depending on contractual arrangements and circumstances, or are subject to our instructions as to the purposes and methods of data processing (processors) or independently determine the purposes and methods of their processing (administrators). You will receive a list of providers whose services we use on request - send an email to hr@netminds.dk
Netminds uses suppliers who process your personal data only on our instructions. They provide us with a hosting service in the cloud computing, for sending emails, as well as support the implementation of certain functionalities of the Website (e.g. Filling out the Profile with a CV document).
The Netminds Administrator uses suppliers who do not act solely on our instructions and will set the purposes and methods of using your personal data on their own.
You have the right to request Netminds to provide copies of standard contractual clauses by directing the inquiry in the manner indicated in point 2 of the Privacy Policy.
State authorities
Netminds provides your personal data if we are requested by authorized state authorities, in particular organizational units of the prosecutor's office, the Police, the President of the Office for Personal Data Protection, the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications or other administrative bodies authorized by law public.


6. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

Netminds stores your personal data for a period of 8 years for the purposes of the services provided by Netminds and related functionalities and other services. After withdrawing the consent, your data will be anonymized, except for the following data: name, surname, e-mail address, application history and information about consents (we will keep this data for a period of 3 years from deleting the Account for the purpose of considering complaints and claims related to using our services) may also be completely removed from our databases by us.

7. WHAT ARE YOUR RIGHTS IN CONNECTION WITH THE PROCESSING OF YOUR PERSONAL DATA?

Netminds ensure the implementation of your rights indicated below. You can exercise your rights by submitting a request to the e-mail address hr@netminds.dk
Right to withdraw consent
You have the right to withdraw any consent you have given to Netminds, as well as when using individual services and functionalities offered on the Website. Withdrawal of consent does not affect the processing carried out before its withdrawal.
Withdrawal of consent does not entail any negative consequences for you. However, it may prevent further use of services or functionalities that, in accordance with Netminds law, we can only provide with consent (e.g. participation in recruitment processes). Legal basis: art. 7 sec. 3 GDPR.
Right to object to data use
You have the right to object at any time to the use of your personal data, including profiling, if Netminds processes your data based on a legitimate interest.
Opting out of receiving recommended job offers in the form of e-mails, as well as opting out of receiving messages regarding job offers and our clients, will mean your objection to the processing of your personal data.
If your objection turns out to be justified and we have no other legal basis for processing your personal data, we will delete your data to which you objected. Legal basis: art. 21 GDPR.
Right to erasure ("right to be forgotten")
You have the right to request the deletion of all or some of your personal data. The request to delete all personal data will be treated by Netminds as resignation from all services.
You have the right to request the deletion of personal data if:
a) you withdrew a specific consent, to the extent that personal data was processed based on your consent;
b) your personal data are no longer necessary for the purposes for which they were collected or for which they were processed;
c) you objected to the use of your data for marketing purposes;
d) Your personal data is processed unlawfully.
Despite the request to delete personal data, in connection with lodging an objection or withdrawing consent, Netminds has the right to retain certain personal data to the extent necessary for the purposes of establishing, pursuing or defending claims. This applies in particular to personal data including: name, surname, e-mail address and application history, which Netminds retains for the purpose of considering complaints and claims related to the use of our services. Legal basis: art. 17 GDPR.
Right to restriction of data processing
You have the right to request the restriction of the processing of your personal data. If you submit such a request, Netminds will block you from using certain functionalities or services, the use of which will involve the processing of data covered by the request, until it is considered. Netminds will also not send you any messages.
You have the right to request the restriction of the use of your personal data in the following cases:
when you question the correctness of your personal data - then we will limit their use for the time needed for us to verify the correctness of your data
b) when the processing of your data is unlawful, and instead of deleting the data you request restriction of their use;
c) when your personal data are no longer necessary for the purposes for which we collected or used them, but you need them to establish, pursue or defend claims;
d) when you have objected to the use of your data - then the restriction takes place for the time needed to consider whether - due to your particular situation - the protection of your interests, rights and freedoms outweighs the interests that we pursue when processing your personal data;
e) Netminds, upon request to limit the processing of your personal data, has the right to delete it. Legal basis: art. 18 GDPR.

Right of access to data
You have the right to obtain confirmation from Netminds whether we process your personal data, and if this is the case, you have the right to:
a) access your personal data;
b) obtain information about the purposes of processing, categories of personal data being processed, recipients or categories of recipients of this data, the planned period of storing your data or the criteria for determining this period, about your rights under the GDPR and the right to lodge a complaint with the supervisory authority, the source of this data, about automated decision-making, including profiling, and about the safeguards applied in connection with the transfer of this data outside the European Union;
c) obtain a copy of your personal data. Legal basis: art. 15 GDPR.
Right to rectification
You have the right to rectify and supplement the personal data provided by you. You can do it yourself by sending a message to the address

8. HOW DO WE KEEP YOUR PERSONAL DATA SECURE?

Netminds makes every effort to ensure the security of your personal data. The websites use encrypted data transmission (SSL) when applying, which ensures the protection of data identifying you and significantly hinders interception of access to your data by unauthorized systems or persons.

 

9. CHANGES TO THE PRIVACY POLICY

According to the needs, Netminds may change and supplement the Privacy Policy. We will inform you about any changes or additions by posting relevant information on the main pages of the Websites, and in the event of significant changes, we may also send you separate notifications to the e-mail address provided by you.
The Privacy Policy does not limit any of your rights under the law.
